Is My Marriage In Texas Legal?

Posted: Friday, November 20, 2009

Twitter is running rampant this morning declaring that no marriage in Texas over the last four years is recognized by the state.

Why did this all start?

According to Democratic candidate for Texas attorney general, Barbara Ann Radnofsky. Radnofsky argues that tricky phrasing in the 2005 amendment designed to out law same sex marriages effectively banned all marries.

Radnosky is quoting Section 32 (b): "This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage."

What she fails to quote is section (a) that clearly defines a marriage as between a man and woman. Hence, people retweeting are unaware and reading section (b) can give some merit to what she said.

Section 32 (a): Marriage in this state shall consist only of the union of one man and one woman."

Therefore, all of you who were married in the last four years, stop the planning for a new wedding. Your marriage is recognized by the state and legal.

Anything can look suspicious taken out of context.

What next - I was married in Texas but that was coming up on 25 years ago - the pastor tied that knot tight and we are happy and together still! Marijo

Hi Abigail.

All sorts of things can be taken wrongly out of context. That's my biggest pet peeve with statistics.

Anyway, thanks for the update and the reminder.
